These Terms of Service ("Terms") govern your access to and use of our website, services, and all associated freight forwarding, transport, and logistics offerings. By accessing our website, requesting a quote, placing a booking, or otherwise engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you are entering into these Terms on behalf of a company, organisation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, references to "you" or "your" shall refer to both the individual and the entity on whose behalf you act.
We reserve the right to refuse service to any person or entity at our sole discretion. If you do not agree with any part of these Terms, you must discontinue use of our website and services immediately. Your continued use of our services following any amendments to these Terms constitutes your acceptance of those amendments.

These Terms are issued by EXPRESS FIRST LOGISTICS PTY LTD, an Australian proprietary limited company registered under the Corporations Act 2001 (Cth). Our registered business address is 1-15 Wentworth Road North, Homebush NSW 2140, Australia. Our Australian Business Number (ABN) is [TO BE ADDED].
Express First Logistics operates as a freight forwarding and logistics service provider throughout Australia, offering domestic and international transport, warehousing, and supply chain management solutions. We are committed to complying with all applicable Australian laws and regulations, including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law set out in Schedule 2 of that Act.

3. Services
Express First Logistics provides a comprehensive range of freight forwarding, transport, and logistics services. These services include, but are not limited to, domestic road freight, interstate express delivery, international sea and air freight, customs brokerage, warehousing and distribution, and tailored supply chain solutions for businesses of all sizes.
The specific scope, nature, and terms of any service provided to you will be outlined in the relevant quotation, service agreement, or booking confirmation issued by us. Where there is any inconsistency between these Terms and a specific service agreement or quotation, the terms of the specific service agreement or quotation shall prevail to the extent of the inconsistency.
We endeavour to deliver all services with due care and skill in accordance with industry standards and applicable Australian regulations. However, we do not guarantee specific transit times unless expressly agreed in writing. Estimated delivery timeframes are provided in good faith based on standard operating conditions and may be affected by factors beyond our reasonable control, including weather events, customs delays, carrier disruptions, and public holidays.
We reserve the right to subcontract any part of our services to third-party carriers, agents, or service providers where we deem it necessary or appropriate to fulfil your booking.
4. Quotes & Pricing
All quotations provided by Express First Logistics are denominated in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless expressly stated otherwise. Quotes are based on the information supplied by you at the time of the request, including but not limited to consignment dimensions, weight, origin, destination, and any special handling requirements.
Quotations are valid for a period of fourteen (14) days from the date of issue unless otherwise specified in writing. We reserve the right to revise any quotation if the actual consignment details differ materially from the information originally provided, including variations in weight, volume, dimensions, or the nature of the goods. Additional charges may apply for services not included in the original quotation, such as re-delivery attempts, storage fees, customs duties, and insurance.
Pricing may be subject to fuel surcharges, toll charges, and other variable costs that fluctuate based on market conditions. Where such surcharges apply, we will make reasonable efforts to notify you in advance. Payment terms will be outlined in the relevant invoice or service agreement, and unless otherwise agreed, payment is due within thirty (30) days of the invoice date. Late payments may incur interest at the rate prescribed under the Penalty Interest Rates Act 1983 (NSW) or as otherwise agreed between the parties.
5. Bookings & Cancellations
A booking is considered confirmed once you have accepted a quotation and we have issued a booking confirmation via email or through our online booking system. Upon confirmation, you agree to the terms outlined in the booking confirmation, including collection and delivery details, pricing, and any special instructions.
You may request cancellation of a confirmed booking by providing written notice to us. Cancellations made more than twenty-four (24) hours prior to the scheduled collection time will not incur a cancellation fee. Cancellations made within twenty-four (24) hours of the scheduled collection time, or after the goods have been collected, may attract a cancellation fee of up to the full quoted amount, depending on the costs already incurred by Express First Logistics and any third-party carriers engaged for the booking.
We reserve the right to cancel or reschedule a booking where circumstances beyond our reasonable control prevent us from fulfilling the service, including force majeure events, carrier unavailability, or unsafe transport conditions. In such cases, we will notify you as soon as reasonably practicable and work with you to arrange an alternative solution. Where we cancel a booking due to circumstances within our control, you will be entitled to a full refund of any amounts paid in advance for that service.
It is your responsibility to ensure that all booking details, including collection and delivery addresses, contact information, and consignment descriptions, are accurate and complete at the time of booking. Express First Logistics accepts no liability for delays, losses, or additional charges arising from inaccurate or incomplete booking information provided by you.
6. Liability & Limitations
To the maximum extent permitted by law, Express First Logistics' total liability for any claim arising out of or in connection with our services, whether in contract, tort (including negligence), under statute, or otherwise, shall not exceed the lesser of the value of the goods as declared at the time of booking or the amount of fees paid by you for the specific service giving rise to the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement. If our services are supplied to you as a consumer within the meaning of the Australian Consumer Law, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
To the extent permitted by law, Express First Logistics excludes all liability for indirect, consequential, special, or incidental losses or damages, including but not limited to loss of profits, loss of revenue, loss of business opportunity, loss of data, or business interruption, whether or not such losses were foreseeable or we were advised of their possibility.
Express First Logistics shall not be liable for any loss, damage, or delay caused by events or circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, industrial action, government actions or restrictions, carrier failures, road closures, or severe weather events. You are encouraged to obtain appropriate insurance coverage for your goods during transit.
7. Prohibited Items
You must not consign, and Express First Logistics will not knowingly accept for transport, any items that are classified as prohibited or restricted under Australian law. Prohibited items include, but are not limited to, illegal drugs and narcotics, unlicensed firearms and weapons, explosive materials, toxic or radioactive substances, counterfeit goods, and any items the possession or transport of which is prohibited under Commonwealth or State legislation.
Dangerous goods as defined under the Australian Dangerous Goods Code (ADG Code) and the Australian Code for the Transport of Dangerous Goods by Road and Rail may only be transported with our prior written consent and in full compliance with all applicable regulations, including proper classification, packaging, labelling, and documentation. Additional fees and conditions will apply to the transport of authorised dangerous goods.
You warrant that all goods consigned to Express First Logistics are lawful to possess and transport within Australia and, where applicable, comply with all import and export regulations. If prohibited or undeclared dangerous goods are discovered within a consignment, we reserve the right to refuse carriage, return the goods at your expense, dispose of the goods where required for safety, or report the matter to relevant authorities. You agree to indemnify and hold Express First Logistics harmless from and against any losses, damages, fines, penalties, or claims arising from your consignment of prohibited or undeclared items.
8. Intellectual Property
All content, materials, and intellectual property displayed on or accessible through the Express First Logistics website, including but not limited to text, graphics, logos, images, icons, software, trademarks, service marks, and trade names, are the property of Express First Logistics Pty Ltd or its licensors and are protected under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth), and other applicable intellectual property laws of Australia and international treaties.
You are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use our website for personal or internal business purposes directly related to engaging our services. You must not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our website without our prior written consent.
Any feedback, suggestions, or ideas you provide to Express First Logistics regarding our services or website may be used by us without restriction or obligation to compensate you. Nothing in these Terms transfers any intellectual property rights to you beyond the limited licence described above. Unauthorised use of our intellectual property may result in legal action, including claims for damages and injunctive relief.
9. User Responsibilities
You are responsible for ensuring that all information provided to Express First Logistics is accurate, complete, and up to date. This includes, without limitation, consignment descriptions, declared values, weight and dimensions, collection and delivery addresses, and recipient contact details. Inaccurate or incomplete information may result in delays, additional charges, or inability to complete the service.
You must ensure that all goods presented for transport are adequately and appropriately packaged to withstand normal handling during transit. Express First Logistics shall not be liable for damage to goods that are inadequately packaged. Where goods require special handling, temperature control, or specific storage conditions, you must clearly communicate these requirements at the time of booking.
You agree to comply with all applicable laws, regulations, and industry codes in connection with your use of our services, including customs and import/export regulations, biosecurity requirements, and workplace health and safety obligations. You must ensure that authorised persons are available at the collection and delivery points at the agreed times to facilitate the loading and unloading of goods.
You must not use our website or services for any unlawful purpose, to transmit harmful or malicious content, or in any manner that could damage, disable, or impair our systems or interfere with other users' access to our services. You agree to indemnify Express First Logistics against any claims, losses, or expenses arising from your breach of these responsibilities.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts for the resolution of any disputes arising out of or in connection with these Terms or your use of our services.
Nothing in these Terms is intended to exclude or limit the operation of any applicable mandatory legislation, including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law. To the extent that any provision of these Terms is found to be inconsistent with mandatory statutory rights, that provision shall be read down or severed to the minimum extent necessary to ensure compliance with the law, and the remaining provisions shall continue in full force and effect.
In the event of any dispute arising under these Terms, the parties agree to first attempt to resolve the matter through good faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may refer the matter to mediation administered by the Australian Disputes Centre (ADC) in Sydney, New South Wales, before commencing court proceedings. The costs of mediation shall be shared equally between the parties unless otherwise agreed or ordered.
11. Changes to Terms
Express First Logistics reserves the right to amend, update, or replace these Terms at any time at our sole discretion. When we make material changes to these Terms, we will update the "Last updated" date at the top of this page and, where practicable, provide notice of significant changes through our website or by email to registered users.
It is your responsibility to review these Terms periodically to stay informed of any updates. Your continued use of our website or services after the publication of amended Terms constitutes your acceptance of those amendments. If you do not agree with any changes to these Terms, you must cease using our services and notify us in writing.
For ongoing service agreements, any changes to these Terms will apply to bookings made after the effective date of the amendment. Bookings confirmed prior to the effective date of any amendment will be governed by the Terms in effect at the time the booking was confirmed, unless otherwise agreed in writing between the parties.
